Domestically, that young teenage mother applies for, and receives, loot and booty taken from you by force and so she bears a few more hungry mouthes...
These hungry mouthes are then fed, clothed, sheltered, educated, and raised with additional loot and booty and they then bear even more hungry mouthes...
Isn't it plain to see that if the loot and booty was not there...then the "weight" and responsibility of these creations would fall more squarely upon the original shoulders...
And not on those others, as have allowed the theft and robbery, the loot and booty, to aid and assist in the destructive cycle which breeds and bears these creatures...
Much the same as this goes on domestically...the same is true of the international condition...
We are bombarded with cries, stories, and scenes from across the globe...poverty...homelessness...hunger...death...destruction...mutilation...rape...murder...genocide...

The legislature that invaded the homes of private citizens with these laws need to be brought up on charges and Hanged
The governor (Shaheen, Benson and Lynch all party to these crimes) that signed these bills into law needs to be impeached, charged and executed along with those members of the legislature
The judiciary committe that approved these bills for law need to be removed from office for incompetence

Have can a candidate receive over 19 million popular votes but not get any Electoral Votes? To answer this question, I must first explain to you the American public who is really deciding our Presidential elections.
For the purpose of electing the President and Vice President of the United States a 538-member Electoral College is created with each state having as many electors as it has representatives and senators in the national legislature, plus 3 for the District of Columbia. To be elected, a candidate must obtain an absolute majority in the Electoral College, currently 270. If no candidate gains an absolute majority the US House of Representatives makes the choice, with the delegation from each state having one vote.
Opponents of the Electoral College counter that it does not require candidates to cultivate greater and broader support throughout the entire nation. The electors could elect a candidate who wins by small margins in only a few of the largest states over another candidate who wins by large margins in all the rest of the states. In fact, given the 2000 allocation of electors, a candidate could have won with only the support of 11 states.
A result of the present functionality of the Electoral College is that the national popular vote bears no legal or factual significance on determining the outcome of the election. As the aggregate popular vote is irrelevant, both voters and candidates may base their campaign strategies around the existence of the Electoral College. Claims that the Electoral College suppresses the popular will are therefore legitimately open to debate.
The effects of this phenomenon are somewhat known, but impossible to quantitatively predict in any close election such as 2000, when Al Gore received more of the popular vote than George W. Bush.

The Democrats now find themselves in a thoroughly uncomfortable dilemma over Iraq.
Back in the early days of the American invasion, when things were going relatively badly, Democratic Senate Majority Leader Harry Reid announced the war was "lost" and America's only recourse was to pull out. (This, of course, would have been an absolute political disaster for the Bush administration, as Mr. Reid no doubt knew and hoped.) In the subsequent months and years, when things there have gone substantially better, Mr. Reid has never retracted his highly premature conclusion but it is safe to say it is now "inoperative."
According to such sources as the New York Times, which can hardly be described as having been a cheerleader for the attack, the al Qaeda forces in Iraq are now thoroughly on the defensive, and Nouri al-Maliki's government is strengthening its grip on the country. It seems likely that George W. Bush will achieve his goal of stepping down as president with the Iraq problem well on its way to a solution.
That leaves the Democrats in a bit of a pickle. What, exactly, is their current policy on Iraq? It would be out of the question to insist, in the teeth of the good news from Iraq, that the United States should adopt the former Democratic policy and simply bug out. And, in purely political terms, it would be equally difficult for the Democrats to admit they were wrong, reverse their position and endorse the administration policy.
Is there some middle road they could safely take? It's hard to envision what it might be. Either the United States must insist on prevailing, as it is currently doing, or substantially abandon the region altogether. And it's hard to imagine any more disastrous policy than the latter. The Middle East has for decades been both one of the most critical areas on Earth, thanks to its indispensable reserves of oil, and also one of the most volatile, by virtue of its ethnic and religious quarrels. To abandon it would verge on economic suicide.
It is not surprising, then, that at the moment there is no settled Democratic policy on Iraq. If the Democrats win in November, the cooler heads in the party will presumably prevail and endorse a policy not all that different from that of President Bush - i.e., sustaining the current regimes in Iraq and elsewhere in the region that support U.S. policy. But between now and Election Day the Democrats need a Middle East policy different from Mr. Bush's yet not obviously suicidal - and they just don't have one.
For the moment, the Democratic answer is silence. And it's hard not to feel it is probably their best bet. After all, Election Day is just four-and-a-half months away, and there are plenty of other issues the Democrats can seize on to emphasize their sharp differences with the Republicans.
But the American people are hardly unaware of the importance of the Middle East, and of America's stake in that area. And they will credit President Bush with the wisdom to recognize these and devise policies that take them into account. Painful as American losses - any losses - in the Middle East may be, they pale in comparison to those our country would suffer if it lost the capacity to influence events there.
We must never forget that there are individual despots, and whole nations, in the Middle East who despise the United States and would gladly drive it out of the region, and deprive us of its oil reserves, if only they could. Keeping that from happening must be a cardinal aim of U.S. foreign policy and ought to be a matter of bipartisan agreement. That is why, despite the understandable distaste partisan Democrats would feel at having to endorse a Republican policy, the happiest result for the United States, and the soundest long-run course for the Democratic Party, would be a Democratic decision to endorse President Bush's policy in Iraq.

As a result of this terror, and the ensuing fear that it created, Susan required counseling and medication for her insomnia. The medication caused some side effects, one of which were terrible mood swings. Dave was not able to cope with Susan's terror, fear, and anxieties. Their marriage fell apart and David filed for divorce.
David's family and friends didn't understand and turned away from him in disgust that he would leave his wife. David's employer was not understanding of his time away from work to pursue his own counseling and the divorce. His employment contract was terminated.
Now, homeless and unemployed, with no neighbors and few friends, David turned to drugs and alcohol to mask the pain. Drunk and stumbling through the streets one night he encountered the police. Handcuffed, a search revealed some prescription drugs...that he didn't have a prescription for...so he was taken to jail. Mandatory sentencing meant that, after his conviction, David would spend time in a minimum security incarceration facility.
And that's when the REAL TERROR began.
David soon realized that he was no match for the huge, hulking animals that he was locked up with. His new cell-mate not only repeated raped him each day, but also "pimped" him out to the other animals. The guards actually enjoyed seeing the inmates assaulting each other...and leaving the guards free to watch the show.
Four hundred and eleven days after David and Susan's terror began, David hung himself to escape the brutal daily rapes.
Epilogue:

There are no prerequisites other than you come with as open of a mindset as you are personally capable of...and we will go from there.
We must, however, state that these classes and groups would be moderated. We will gladly answer sincere questions and misunderstandings but we will not tolerate the wasting of everyone's precious and valuable time with an agitator.

What makes NH different from other states?
How do those differences allow us to have a better chance at survival?
How do I keep my neighbor from looting my house?
How do we keep marauding looters from the big cities from destroying what we've worked so hard to secure?
Will we be able to secure our state borders?
Will we be allowed to secure them?
Will our sons and daughters serving in the military be allowed to come home to help us?
What will happen to me if I get caught stealing?
What will happen to all the inmates in jails and prisons?
Why do we have almost two million people in prison anyway?
What is a "victimless crime" and why are the prisons overflowing with these people?
If we release all the non-violent prisoners won't that decrease the taxes needed to run the jails and prisons?
If we start homeschooling, or private neighborhood schooling, won't that save billions that are currently spent on schools, administrators, buses, etc.?
Wouldn't that reduction in fuel consumption from all those school buses not only save millions, but wouldn't that also keep our air cleaner?
So...
Is anyone even remotely interested in what's going to happen in the next few months?
The real estate bubble is bursting(but far from over and, no matter what the gooberment does, the market will eventually self-adjust and a "value reduction" of 60 to 80 percent should be expected)...
The economy is failing because we don't PRODUCE here...in the US...witness everything being "made in (insert some foreign country here)"...
The stock market is faltering and trying to re-adjust itself to the falling and failing US Dollar that is "backed" by nothing...other than "good faith"...the hope that you may get something for it when you hand it to someone else...
What happens when no one will take it?
Hyper-Inflation of the US Dollar is inevitable...You can see this easily when you think back to the average wage when a gallon of gasoline was one dollar...Now that a gallon is three dollars...Has the average wage gone up 300 percent? I don't think so...and even if it has...this still proves inflation...
So the criminal elite will try to hide the failing dollar by "converting" or "changing" our "money" somehow...
It may or may not be directly to the "Amero"...doesn't matter...the switch will be used to "hide" the inflationary "robbery" against anyone "holding" US Dollars...
And, China can afford to lose all that "value" from their massive US Dollar "holdings" because they ARE producing...and they ARE exporting trillions of dollars worth of goods...to customers all over the world...
America WAS great because we WERE self-sufficient...We produced what we wanted and needed right here in the USA...Now I'm not an isolationist...But I am a realist...and if you don't actually produce items of value to trade with other people for the items of value that they produce...a "trade imbalance" occurs...
The trade imbalance between the USA and other countries is putting the USA into the trash heap of empires...(study the history of the roman empire for more parallels)...Sure we still export weapons of mass destruction to other countries...even Iraq and Iran(and yes they are STILL getting US built tools of war...you just don't know about it)...

What should we do about it now?

There are four branches of "government". Mostly you only think and hear about three of them. The legislative, the executive, and the judicial. The fourth branch is "We The People" and it's the SOURCE of our representative constitutional republic(it should be noted that we have NEVER been a "democracy" as that would be "mob rule" and who wants that? - for more information see www.democracyisnotfreedom.com).
More about the fourth branch and We The People. Individual sovereign human beings know(or should know) that they have basic, inherent human rights. There are NO "collective" rights, that is...the rights of 100 people standing together are PARALLEL and they DO NOT, ever, "combine" or become "collective".
A very simple and brief example of this is probably in order. Let's use wolves and sheep in our example. How many wolves does it take to "vote" to eat a sheep for lunch? One? Ten? Ninety-five? In a "democracy" the sheep becomes lunch. In a representative constitutional republic, having the sheep for lunch isn't even "on the table" for a vote. The sheep also keep and bear arms just in case the wolves someday "think" and/or "decide" that they are a "democracy" with the mob mentality of raping, pillaging, and looting. After they do that, the sheep have plenty of wolf pelts to "warn" future wolves to leave them alone...
So I guess I still haven't told you why/how you are the most important person in the world yet so here goes. Take a deep breath before we go down "the rabbit hole".
YOU, yes you, are the "last line of defense" for "We The People". YOU hold a key a thousand times more powerful than the soapbox(letters to the editor, for example), the ballot box(you know what that is, right?), and even the cartridge box(for those who might not know, a cartridge is the proper term for an assembly of casing, primer, powder, and projectile, aka, slang term "bullet"). So now you've come to the one box that we haven't mentioned yet, the JURY box.
Learn the truth of YOUR power and your ability to be the salvation of your unjustly accused brothers and sisters. YOU have a right, and a solemn duty, to judge EVERYTHING at trail. The law, the accusers, the accused, the evidence, the investigators, the procedures, EVERY SINGLE THING...even your fellow jurors!

"By actually working with the Black lower class or within their communities as a result of their ideologies, a separationist may better understand the desperation of their situation and feel more hopeless about a resolution as opposed to an integrationist who is ignorant to their plight."
Obama writes that the path she chose by attending Princeton would likely lead to her "further integration and/or assimilation into a white cultural and social structure that will only allow me to remain on the periphery of society; never becoming a full participant."
Michele Obama clearly has a chip on her shoulder.
Not only does she see separate black and white societies in America , but she elevates black over white in her world.
Here is another passage that is uncomfortable and ominous in meaning:
"There was no doubt in my mind that as a member of the black community, I am obligated to this community and will utilize all of my present and future resources to benefit the black community first and foremost. "
What is Michelle Obama planning to do with her future resources if she's first lady that will elevate black over white in America ?
The following passage appears to be a call to arms for affirmative action policies that could be the hallmark of an Obama administration.
"Predominately white universities like Princeton are socially and academically designed to cater to the needs of the white students comprising the bulk of their enrollments."
The conclusion of her thesis is alarming.
Michelle Obama's poll of black alumni concludes that other black students at Princeton do not share her obsession with blackness. But rather than celebrate, she is horrified that black alumni identify with our common American culture more than they value the color of their skin. "I hoped that these findings would help me conclude that despite the high degree of identification with whites as a result of the educational and occupational path that black Princeton alumni follow, the alumni would still maintain a certain level of identification with the black community. However, these findings do not support this possibility."
Is it no wonder that most black alumni ignored her racist questionnaire? Only 89 students responded out of 400 who were asked for input.
Michelle Obama does not look into a crowd of Obama supporters and see Americans. She sees black people and white people eternally conflicted with one another.
The thesis provides a trove of Mrs. Obama's thoughts and world view seen through a race-based prism.
This is a very divisive view for a potential first lady that would do untold damage to race relations in this country in a Barack Obama administration.
Michelle Obama's intellectually refined racism should give American's a pause for deep concern.
Now maybe she's changed, but she sure sounds like someone with an axe to grind with America . Will the press let Michelle get a free pass over her obviously racist comment about American whites? I am sure that it will. But it shouldn't.

I am not a supporter of any of the candidates for president. In fact, they all leave a bad taste in my mouth. However, I am definitely sick of the main stream media (MSM) feeding us all this crap about Obama being an agent of change.

Chicago's sordid political machine churned out another felon last week. Ho hum. That's business as usual in the Windy City, unfortunately. As news bulletins blared the latest political casualty, Northsiders and Southsiders alike shrugged—seemingly inured to the steady stream of arrests, indictments and convictions that too often define what Chicago Tribune columnist John Kass aptly terms "The Chicago Way." This conviction, however, represents more than an average garden-variety corruption scandal. The demise of crooked businessman and political fixer Tony Rezko may very well end the political career of Illinois Governor Rod Blagojevich. Perhaps more significantly, it adds another name to the expanding roster of Sen. Barack Obama's disgraced friends, donors, and associates.
Prior to Wednesday's verdict, the national Obamedia paid scant attention to the relationship between their preferred candidate and Mr. Rezko, who was convicted on 16 of 24 federal counts. A jury found Obama's longtime friend and financier guilty of aiding and abetting bribery, mail fraud, wire fraud, and money laundering—all of which will likely contribute to a lengthy prison sentence. The federal convict and the presumptive Democratic presidential nominee have known each other for the better part of two decades, with the former raising approximately $250,000 for the latter's various campaigns. After Rezko first offered Obama a job in the early 1990s, a friendship and political alliance was born; the two men shared dinners, joint outings with their wives, and a lucrative political network. Rezko served on Obama's financing committee during his 2004 campaign, helping to raise approximately $160,000 for the aspiring U.S. Senator. Shortly thereafter, dark clouds began to gather over Chateau Rezko.
By 2005, Rezko's shady business deals and alleged illegal activities had been widely reported in the Chicago press. Even so, Obama decided it would be a wise move to enter into a major property deal with his scandal-tainted friend. On the very same day Obama paid $1.65 million (a substantially smaller sum than the asking price) for his Hyde Park mansion, another buyer purchased an adjoining lot for $625,000—an additional sum the Obama's could not afford. The new owner? Rezko's wife, Rita, who somehow managed to secure the property despite an annual salary of $37,000. A short while later, Mrs. Rezko generously sold a strip of her new property to Obama so he could build a fence he had been hoping for. At the time of this second transaction, Obama admits he knew Rezko was experiencing some "legal problems." Nonetheless, the deal went through and a lovely wrought-iron fence—paid for by Rezko—was erected between the two properties. The whole episode worked out pretty nicely for Obama. One might even call it an "exchange we can believe in."
Now with Rezko facing a decidedly different type of iron fence, his deep ties to Obama demand further examination. The scandal presents three problems for Senator Obama:
First, anyone who watches Law & Order knows that the State constantly seeks to land the biggest fish possible. Convicted felons are sometimes offered legal carrots to help the prosecution produce even bigger scalps higher up the ladder. In this particular case, the likeliest prize is Gov. Blagojevich, whose ethical bankruptcy came to light during Rezko's trial. Even so, if Rezko has any dirt on Obama, such information could prove quite valuable to a man facing decades in federal prison. Any public figure with skeletons in Rezko's closet should be sweating over the thought of Rezko playing Deal or No Deal with US Attorney Patrick Fitzgerald. Then again, given Rezko's sterling reputation, pristine character, and undying loyalty, I'm sure Obama has nothing to worry about.
Second, this relationship also shows Obama is not only a typical politician, but a typical Chicago politician. When the crooked machine produces hundreds of thousands in campaign dollars, a series of prestigious elected offices, and an elegant home, one doesn't ask too many questions. Obama was more than happy to ride the gravy train, even after he got a noxious whiff of corruption. That's the Chicago Way.
This also exposes Obama's promise of a "new kind of politics" and squeaky-clean ethics as empty platitudes. His campaign website devotes an entire page to ethics, boasting—somewhat disingenuously —that Obama is the only major candidate who rejects fundraising dollars from lobbyists. He says he's "done more than any other candidate in this race" to take on lobbyists and corruption. Evidently those evil lobbyists are the primary threat to clean governmental ethics, as opposed to corrupt fundraisers who help candidates seal multimillion dollar property deals. As the campaign moves forward, every time Democrats try to tar John McCain for some nebulous tie to a lobbyist, the Republican can fire back, "Last time I checked, my longtime friends and fundraisers aren't in federal prison."
Finally, and most strikingly, Rezko's downfall raises more alarming questions about Barack Obama's judgment. This would be less of an issue for Obama if he hadn't just traipsed across the country for months speaking at podiums with the slogan "Judgment To Lead" emblazoned on the front. Experience is overrated, Obama tells us. In fact, his paper-thin presidential resume and far-left voting record really aren't that important compared to his stellar judgment. This argument is precisely the reason why Obama's gripes about "distracting" media scrutiny of his associations should fall on deaf ears. One of the few ways to cut through his enigmatic persona is to study the people with whom he's surrounded himself for decades. The list isn't reassuring: Rev. Wright, Father Pfleger, William Ayers, Bernadine Dohrn, Rashid Khalidi, and Tony Rezko.
Obama recently expressed shock that his church had become the subject of political controversy. Really? Was there another reason why he uninvited Jeremiah Wright to join him onstage at his presidential announcement last year? When he finally threw Wright under the bus upon hearing a regurgitation of Wright's craziest hits at the National Press Club, he soberly stated the raving reverend was "not the same man I knew 20 years ago." When asked about the Rezko verdict, Obama again claimed to be baffled: "This isn't the Tony Rezko I knew," he lamented. Sound familiar?
One has to wonder if Obama believes the American people to be a bunch of patsies. Perhaps he confuses the rest of us with his most ardent supporters, who reflexively applaud everything he says or does. The majority of American voters aren't yet mesmerized by his spell, and this cynical act is starting to wear thin. He expects us to believe that he's been an innocent sheep in the midst of barely-disguised wolves for decades, and that he was oblivious to their true nature all the while. He seems to think we're buying the canned line from his internal TelePrompter that reads, "This isn't the [fill in name of disgraced friend/radical associate] that I've known for [X] years." When does this refrain become inoperable?
Maybe it's cynical and unfair to assume that Obama is a liar who's simply spinning tales in order to get elected. Let's give him the benefit of the doubt and take him at his word: He's a naive man who consistently, and badly, misjudges the character of even his closest associates. If he's truly unable to discern the intentions of Jeremiah Wright and Tony Rezko after decades-long friendships, it's completely reasonable to worry about his ability to effectively deal with antagonistic world leaders whose subversive intentions pose grave threats to world peace.
The Rezko aftermath forces Americans to wonder: Is Obama lying, or is he just clueless? Neither answer inspires much confidence in his ability to effectively lead our nation.
I registered at raymond town hall as a republican now the town clerk says she has no record of my standing as a registered republican. So I must have 35 write in votes for the Sept primary.
I honor many traditional values but the most important is your right to freedom and to end the states picking your pocket to fund programs that are not able to function or achieve their goals with in a reasonable time or fiscal limit.
Schools want more control over your childs life yet many schools are unable to provide a non violent and safe envioronment and solid teaching of the foundational studies in English, Science and the arts.
I support charter schools. It seems that unions have provided for their members but at a great expense to taxpayers and students.
Why so much opposition to charter schools? I think they realize that when
taxpayers have a choice they will run from the public schools.
Why am I running? I recently went back to University as a non traditional student. I am finishing a degree in Family Science with minors in education and psychology. One course was solely on how to lobby for family issues and about policy issues that effect families.
Oddly I find my most 'liberal' Prof to be the most closed minded about values they do not embrace.
The first day of class I mention I went to seminary.
Well we were given a 5 minute lecture about how conservative people need to be open minded.....He never once mentioned that people that have a more 'liberal' view should be open minded about the positive aspects of conservative values. After all many "conservative" people built this nation so we might have a few good qualities.
It has been a repeated theme at UNH that More Government programs are needed and of course more university trained people should take over the decissions that have traditionally been the function of parents.
I find this view that trained professionals can make better decissions about your childs moral welfare rather then a loving parent offensive and with out merit.
I find the teachers are lacking a compass for their own lives and values so why should they be qualified to tell YOU how to raise your child?
If their theories worked would they not have loving marriages and well adjusted children? Sadly many dont' and if you have a spare moral compass you may wish to send it to these teachers of mental health.
People can reach their goals if we teach them the skills they need to achieve . I support programs that HELP people through tough times and honor the families ability to pull them selves up with some help. So many programs are geared at creating a life long client that insures the agency continues to recieve grants that come from tax payers. The clients are treated as infants that are not capable to study or work or move beyond complete dependence.
An educated client and citizen will have options to help themselves and to be a great asset to their community. They will also experience pride in a job well done. Why are we spending a fortune on social programs that are profitable for agencies with Government contracts yet our senior citizens go with out food, heat or care? No senior in New Hampshire should go with out heat, medicine or starve.
We have the money it is a matter of how it is spent.
Schools are costing us more but the students are not coming out with the skills needed to compete for jobs and colleges. Some towns excel at providing excellent schools but most are not and yet they require more and more funds to send out children unprepared. Perhaps we need to reframe the issue from a view that more money will fix the problem(it has not so far). Perhaps the issue is that the trend is towards creating 'programs' rather then teaching.
Teachers have powerful unions to fight for their rights. Where are the rights for students to receive an education in a school free of drugs and violence? Where are the rights of parents and taxpayers to have quality education for the vast amount of dollars spent?
Schools are not meant to replace parents they are there to educate students. Perhaps we need to get back to those basics.

Speaking in unscripted environments on important issues, Barack Obama betrays a troubling lack of knowledge. He does not appear to know what he's talking about. In his interview with ABC's Jake Tapper earlier this week, for example, Obama advocated an approach to combating terrorism that is supposedly more attuned to legal issues than the Bush administration's:
It is my firm belief that we can track terrorists, we can crack down on threats against the United States. But we can do so within the constraints of our Constitution. Let's take the example of Guantanamo. What we know is that in previous terrorist attacks, for example, the first attack against the World Trade Center, we were able to arrest those responsible, put them on trial. They are currently in U.S. prisons, incapacitated.
Andrew McCarthy (the lead prosecutor of the perpetrators of the 1993 WTC attack) comments:
This is a remarkably ignorant account of the American experience with jihadism. In point of fact, while the government managed to prosecute many people responsible for the 1993 WTC bombing, many also escaped prosecution because of the limits on civilian criminal prosecution. Some who contributed to the attack, like Khalid Sheikh Mohammed, continued to operate freely because they were beyond the system’s capacity to apprehend. Abdul Rahman Yasin was released prematurely because there was not sufficient evidence to hold him — he fled to Iraq, where he was harbored for a decade (and has never been apprehended).
McCarthy discusses the subsequent terrorist attacks on Americans and American assets during the Clinton administration culminating in the 9/11 attack at the outset of the Bush administration. He notes the futility of the law enforcement approach to combating terrorism. But Obama's comments fall short on additional factual grounds as well.
The convicted spiritual mentor of the 1993 WTC bombers is Omar Abdel-Rahman ("the blind sheikh"). According to Obama, the blind sheikh was "incapacitated" and therefore rendered harmless by his conviction and imprisonment. In fact, however, with the assistance of attorney Lynne Stewart, Abdel-Rahman continued to wage jihad from behind bars, issuing instructions to his followers in Egypt. Stewart has been convicted for the assistance she lent to Abdel-Rahman, but she remains at liberty. (I wrote about my own close encounter with Stewart while she was under indictment in "Face to face with Lynne Stewart.")
Speaking at a town hall meeting in Pennsylvania last Saturday, Obama addressed the Supreme Court's Boumediene decision granting Guantanamo detainees the right to challenge their confinement through habeas corpus proceedings in federal court. Obama asserted that the "principle of habeas corpus, that a state can't just hold you for any reason without charging you and without giving you any kind of due process -- that’s the essence of who we are." He explained:
I mean, you remember during the Nuremberg trials, part of what made us different was even after these Nazis had performed atrocities that no one had ever seen before, we still gave them a day in court and that taught the entire world about who we are but also the basic principles of rule of law. Now the Supreme Court upheld that principle yesterday.
John Hinderaker and I derived some precepts for trial lawyers from the Nuremberg trial in "Lessons from the cross-examination of Hermann Goering." In the course of researching that article I was reminded that the Nuremberg trial was conducted before a military commission composed of representatives of the United States, Great Britain, France and the Soviet Union. The most prominent surviving Nazi leaders were brought for trial before the Nuremberg tribunal in late 1945. Winston Churchill had proposed, not unreasonably, that they be summarily shot. The victorious allies nevertheless subsequently agreed that they would be brought before a military commission to be convened pursuant to the London Agreement of August 8, 1945.
In Boumediene, the Supreme Court disapproved of the system of military commissions Congress had adopted at the Supreme Court's urging. Obama to the contrary notwithstanding, the Nuremberg defendants' "day in court" occurred before the kind of tribunal the Supreme Court found constitutionally inadequate in Boumediene.
The Nazi war criminals were given no access to American courts. Their rights were governed by the charter annexed to the London Agreement. Here is the fair trial provision of the charter:
In order to ensure fair trial for the Defendants, the following procedure shall be followed:
(a) The Indictment shall include full particulars specifying in detail the charges against the Defendants. A copy of the Indictment and of all the documents lodged with the Indictment, translated into a language which he understands, shall be furnished to the Defendant at reasonable time before the Trial.
(b) During any preliminary examination or trial of a Defendant he will have the right to give any explanation relevant to the charges made against him.
(c) A preliminary examination of a Defendant and his Trial shall be conducted in, or translated into, a language which the Defendant understands.
(d) A Defendant shall have the right to conduct his own defense before the Tribunal or to have the assistance of Counsel.
(e) A Defendant shall have the right through himself or through his Counsel to present evidence at the Trial in support of his defense, and to cross-examine any witness called by the Prosecution.
The charter provision on the appeal rights of the Nuremberg defendants was even shorter and sweeter. There were no appeal rights. Article 26 provided: "The judgment of the Tribunal as to the guilt or the innocence of any Defendant shall give the reasons on which it is based, and shall be final and not subject to review."
In short, the procedural protections afforded the Guantanamo detainees under the statute before the Supreme Court in Boumediene substantially exceed those accorded the Nuremberg defendants. Obama's unfavorable comparison of the legal treatment of the Guantanamo detainees with that of the Nuremberg defendants suggests either that he does not know what he's talking about, or that he feels free to take great liberties with the truth.
